1. Introduction

Welcome to CMK! These Terms and Conditions govern your use of our website and services. By accessing or using CMK, you agree to be bound by these terms.

CMK is a listings and discovery platform for construction materials, machinery for hire, and transporters in Kenya. Listings are provided by independent suppliers, machinery owners, and transporters.

2. No Cart, No Checkout — Transactions Happen Off-Platform

CMK does not process payments, hold funds, or run a cart/checkout system. Every "Buy on WhatsApp" or "Enquire on WhatsApp" button opens a chat directly with the supplier, machinery owner, or transporter — all negotiation, payment, and delivery arrangements happen between you and them, outside of CMK.

3. Supplier, Machinery Owner & Transporter Accounts

Suppliers, machinery owners, and transporters who list on CMK must register and provide accurate business/contact information. Transporter listings are reviewed and approved by CMK before appearing publicly.

4. Buyer Responsibility

As a buyer, you are responsible for verifying quantity, quality, price, and delivery terms with the supplier or transporter before paying. CMK does not guarantee the accuracy of listing prices, availability, or descriptions.

5. Listings

Materials, machinery, and transporter listings on CMK are created and managed by independent suppliers and operators. We act as a discovery platform to facilitate contact and do not guarantee the quality, accuracy, or availability of any listing.

All listings undergo a review process before going live. However, CMK is not liable for any errors or issues with supplier-provided listing content.

6. Intellectual Property

All content on CMK, including text, graphics, logos, and images, is the property of CMK or its licensors. You may not use, reproduce, or distribute any content without express written permission.

Each vendor retains ownership of their products. By purchasing, you receive a license for personal use as specified by the vendor.

7. Limitation of Liability

CMK shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or purchases.

Our total liability for any claims related to these terms or your use of our services shall not exceed the amount you paid for the specific product giving rise to the claim.

8. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after any changes constitutes acceptance.

9. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
